Former IRS Agent Gets Convicted for Failing to File Her Tax Returns.

The court system will do whatever it can to uphold the tax system. Tax protesters may have the law on their side . . . just not the courts.

But, you say, "the civil law is what the courts say it is." It surely is operationally.

The law can be enforced only with the cooperation of juries. Juries generally cooperate with the prosecutors in tax resistance cases. Anyone who takes on the IRS had better understand this well in advance. Juries generally convict. "If I have to pay, everyone has to pay."

I think people who attempt to beat the tax system by failing to file will wind up like this. However, I think we should do what we can to help those who get caught in the trap.

Dear Friends:

On 2 July and 26 October I wrote you about Sherry Peel Jackson, appealing for you to help her. The federal government was launching its whole weight against one tiny, brave woman in Atlanta, merely because she was a former IRS agent who wouldn't stop telling the truth.

Sounds crazy, but would you give me five minutes to explain?

To shut Sherry up, the IRS charged her with four counts of wilful failure to file income tax returns. She went to trial in October, and was convicted on October 30.

"Well, that cuts it!" you might think, "It was all a hoax. She has to pay her taxes like everybody else. Serves her right."

Please wait a minute, and listen to me. Sherry Jackson is correct, there is no statute that makes anyone except foreign withholding agents liable to pay income tax. Her conviction means absolutely nothing. It's my understanding that witnesses lied from the stand, but unless you have been through a criminal trial in the United States, you can't imagine how meaningless Sherry's conviction really is. There are a million ways to insure a guilty verdict, and the US government knows -- and uses -- all of them.

If she had been convicted a thousand times, Sherry Jackson would still be right, and she would still be innocent. I have watched many of these same cases -- including my own -- and some are convicted, and some are acquitted, without much rhyme or reason. Mounting a defense against what everybody in America "knows" to be correct when it's actually wrong -- well, that's a tough job. It's worse than trying to convince a bunch of flat-earthers that the world is really round.

Where does Sherry stand now? She still needs your help. She's filing motions to reconsider and to overturn the verdict, and she might win on those. Most of all, she needs your help to keep her out of jail. She's the mother of two teenagers. You can flood the judge with letters on her behalf to help her get a reduced sentence. You can't put any arguments or negative comments in the letter, because that will surely hurt Sherry, but you can write that she is a woman of principle and as a mother of two teenagers justice would not be served by sending her to jail. Here's something else you can do. Please send Sherry a donation -- a gift -- to help with her legal expenses. She has the best legal counsel in the country -- I know her lawyers personally and professionally -- but they can't work for free. Sherry is taking the whole country's burden -- yours and mine -- on her own back. The least we can do is make sure she doesn't have to fight and pay as well.
